Cayla Cheree Binder, 18, of Lawton, Iowa, pled guilty Jan. 18 to both Accessory After the Fact and Going Armed with Intent in connection with the stabbing death of Douglas Mitchell Brake Nov. 14 in Hamburg.
On the Accessory charge, District Judge Richard Davidson sentenced Binder to 59 days in jail, with credit for 59 days served.
Fremont County Attorney Margaret Johnson said the charge refers to Binder’s “assisting” with the stabbing and hiding the weapon following the stabbing.
On the charge of Going Armed with Intent, a felony, Judge Davidson granted Binder’s request to delay judgment on the charge and ordered that Binder spend two years on supervised probation. She will be transferred to a residential women’s correctional facility in Council Bluffs. Davidson also ordered that Binder undergo a substance evaluation, pay restitution to the victim’s family and pay $750 in civil penalties.
After five years, if Binder has not committed any violations, she can request that the conviction be removed from her record.
If she violates the terms of her probation, Johnson said Binder’s supervised probation can be extended or she could be sentenced to prison depending on the nature of the violation.
She is currently in jail in Woodbury County, Iowa, where she was charged with criminal mischief and violating probation last fall.
Jennifer Lee Tierney, 18, of Hamburg, is charged with Second Degree Murder in connection with Brake’s death. Her trial was scheduled to begin next month, but has been moved back to April 5 after she waived her right to a speedy trial.
Brake was stabbed in the parking lot of the post office in Hamburg Nov. 14.
